3. Legal Bases and Processing Purposes

Your personal data may be processed as indicated below:

  • Article 6(1)(b) DPA, to conclude an agreement, take steps to conclude it and perform it, until these purposes are fulfilled.
  • Article 6(1)(f) RODO, based on separate consent granted by you for specifically defined purposes, until the purpose is achieved or consent is withdrawn.
  • Article 6(1)(c) DPA, to fulfill legal obligations (including accounting, archiving, tax obligations, and duties towards courts/law enforcement), until these purposes are fulfilled.
  • Article 6(1)(f) RODO, to contact data subjects, respond to complaints/questions, assert or defend claims, and verify persons authorized to represent contractors, until purposes are achieved or an effective, reasoned objection is raised.
  • Article 9(2)(f) RODO, to investigate or defend possible claims, until objectives are achieved, limitation periods expire, or an effective, well-founded objection is lodged.

4. Automated Decision-Making

Your personal data will not be processed for automated decision-making or profiled for this purpose.

5. Data Scope

Your data may include:

  • name and surname,
  • telephone number indicated for contact,
  • correspondence address,
  • e-mail address,
  • name of the company on behalf of which you are acting,
  • your job title.

6. Data Recipients

Recipients of your data may be:

  • entities entitled under law (including tax offices, courts, police),
  • authorized employees of the Administrator,
  • processors under entrustment agreements (including IT, security, courier, consulting companies),
  • other cooperating entities (including debt collection, legal advice, postal services).

7. International Transfers

The Administrator does not disclose your personal data to countries outside the European Economic Area or to international organisations.

8. Security Obligations

All external entities that process your personal data are obliged to ensure data security and comply with data protection obligations.

9. Your Rights

To the extent provided by law, you have:

  • the right to access your personal data and obtain information on processing,
  • the right to rectify inaccurate or incomplete data,
  • the right to erasure ("right to be forgotten"), when processing is no longer necessary,
  • the right to restrict processing (except operations covered by consent), until reasons for restriction cease,
  • the right to data portability for data processed under contract or consent,
  • the right to lodge a complaint with the supervisory authority (President of the Office for Personal Data Protection, 2 Stawki Street, 00-193 Warsaw),
  • the right to withdraw consent at any time (without affecting processing performed before withdrawal), by written or electronic statement to addresses indicated in points 2 and 3,
  • the right to object to processing based on Article 6(1)(f) RODO; in such case, processing will cease unless overriding legitimate grounds exist or processing is needed for establishing, asserting or defending claims.

Your data may be collected:

  • directly from you,
  • from a contracting party that provided data of representatives or contact persons,
  • from publicly available information, in particular the National Court Register or the Central Register and Information on Business Activity.

11. Voluntary Provision of Data

Providing your personal data is voluntary; however, failure to provide it may result in the impossibility to conclude an agreement or take actions aimed at its execution, including contacting you for its execution.
